Except for public autos, commercially used autos are eligible only for bodily injury liability limits up to $1,000,000 for single or split limits and $1,000,000 for property damage liability unless higher limits are required by law or local ordinance as described below.

Limits in excess of $1,000,000, but not exceeding $5,000,000, are offered by the MAIPF to the extent that such limits are required of the applicant by a financial responsibility law enacted by the U.S. Congress or by the state legislature, or when required by the express provisions of any regulation of a federal or state agency authorized by such a law to prescribe specific limits of financial responsibility or by local law or ordinance. The application for coverage must be accompanied by a copy of the statutory provisions delegating the requisite powers, by a copy of the pertinent law, regulation, or ordinance, or evidence of such requirement by federal or state agency, such as a US DOT or MDOT certificate of authority. ??When a state or federal regulated filing or an MCS 90 endorsement is requested, the servicing carrier shall be required to include hired auto and nonowned auto liability coverages in order to comply with the requirements of those filings.

In no event shall the Facility be required to write limits in excess of the basic limits as set forth in this section that exceed $5 million.

Note: The Facility shall be obligated to write limits in excess of the basic limits, as set forth in this section, only when the said basic limits are written through the Facility.
